HUMAIN M3 Limited Preview Terms of Use

Effective Date: 31 August 2026
Last Updated: 31 August 2026

These HUMAIN M3 Limited Preview Terms of Use (“Terms”) govern access to and use of the limited preview of HUMAIN M3 through Node, HUMAIN's online platform and access interface, including its browser-based Playground, any enabled application programming interface, documentation and Research Access (“Preview”). The Preview is made available by AL-MUSTAQBAL LIL-THAKA AL-IISTINAI COMPANY (HUMAIN), commercial register number 1009089438, with its registered address at King Fahd District 3254, King Fahd Branch Street 7295, Postal Code 12262, Riyadh, Kingdom of Saudi Arabia (HUMAIN, we, us or our).

GLOBAL AVAILABILITY WHERE LAWFUL. The Preview is intended for eligible adults worldwide where HUMAIN makes it available and where access and use are lawful. It is not offered in any jurisdiction, to any person or for any end use restricted by applicable law, sanctions, export controls, provider requirements or HUMAIN's operational controls. HUMAIN may block or withdraw access by country, territory, person, organization, network or use case.

IMPORTANT LIMITED PREVIEW NOTICE. HUMAIN M3 is experimental, incomplete and not production-grade. It may change or cease without notice. Outputs may be false, misleading, biased, offensive, unsafe, unlawful, culturally inappropriate, incomplete, outdated or non-unique, and safeguards may fail. Do not rely on an Output as fact, professional advice or a substitute for qualified human judgment.

EVERY PROMPT AND RESPONSE IS RECORDED. Before submitting an interaction, you must separately consent through the Preview interface to recording and authorized automated and human review and to the use of selected interactions and feedback to evaluate, train, fine-tune and further develop HUMAIN M3 and related safeguards. The Privacy Notice describes this processing and your choices.

The HUMAIN M3 Model Terms, Acceptable Use Policy and current Applicable Provider Requirements Register form part of your agreement with HUMAIN. The Privacy Notice explains personal-data processing. The Research Access Addendum applies only if you voluntarily opt in, HUMAIN verifies and approves you, and HUMAIN activates Research Access. If you do not accept the contractual documents and provide the required electronic consents, you must not use the Preview.

1. Eligibility, Territory and Authority

You may use the Preview only if you are at least eighteen (18) years old, have legal capacity to accept these Terms, are not barred from receiving the Preview under applicable law, and access it from a location in which HUMAIN has enabled the Preview. The Preview is not directed to children.

You must provide accurate, current and complete registration, identity, age, country, organization, role and contact information and cooperate with reasonable verification. You must not conceal a restricted location or identity, evade geographic or sanctions controls, or use a proxy or other method to misrepresent eligibility.

If you accept these Terms for an organization, you represent that you have authority to bind it. References to you include that organization where the context permits. Consumer rights that cannot lawfully be waived remain unaffected.

2. Preview Purpose and Access Modes

The Preview exists to evaluate and improve HUMAIN M3's Arabic-language and multilingual capabilities, safety, safeguards, quality and regional or cultural alignment using real-world interactions and feedback. Access is for evaluation, testing and non-production prototyping only.

Guarded Access. Eligible adults may access HUMAIN M3 through the Playground and, where enabled, a scoped API. HUMAIN's safeguards operate as a filtering layer between a user's Input, HUMAIN M3 and the resulting Output and are enabled by default. API access may be limited by account, organization, country, volume, rate, use case and technical controls and must not be exposed to third-party end users unless HUMAIN expressly enables that use.

Research Access. Any eligible adult user may choose to request Research Access. No academic, professional or institutional research credential is required. Research Access is personal, available through the Playground and, where enabled, a scoped API, and subject to verification, approval, session and rate controls. It uses the same underlying model and interfaces as Guarded Access, but HUMAIN may reduce or remove its filtering-layer safeguards. It begins only after an activation notice is issued through a HUMAIN-designated channel.

The Preview does not provide model weights, training datasets, hidden prompts, system configurations, source code or other underlying technology. HUMAIN does not commit to a production release, general availability, continued access, particular features or any future open-weight release.

3. Accounts, Credentials and API Use

You are responsible for your account, credentials, API keys and all activity conducted through them. Keep them confidential, use reasonable security controls, and promptly report suspected loss, compromise or unauthorized access through the channel identified in the Preview interface.

You must not share or transfer an account or credential, permit unauthorized access, sell or redistribute access, circumvent access or usage controls, or use a personal or organizational API key to offer the Preview as a standalone, public, customer-facing, multi-tenant or production service.

HUMAIN may impose or change account, country, model, feature, context, token, rate, concurrency, session and storage limits. Technical capability does not create permission to use a feature or access mode. HUMAIN does not distribute a Node-specific SDK or warrant any third-party client library.

4. Your Inputs, Outputs and Feedback

Inputs include prompts, instructions, uploaded content, files, code, ratings, feedback and other material you submit. You retain rights you have in Inputs. You grant HUMAIN a worldwide, non-exclusive, royalty-free license to host, reproduce, process, transmit, modify and otherwise use Inputs to provide, secure and administer the Preview and, where you separately consent, to evaluate, train, fine-tune and further develop HUMAIN M3 and related systems.

You must have all rights, permissions, notices and lawful authority needed for each Input and its processing under the Preview documents. Do not submit personal, sensitive, confidential, privileged, regulated, classified, export-controlled or security-critical information. Use synthetic or fictitious data wherever possible.

As between you and HUMAIN and to the extent permitted by law, you may use an Output generated for you subject to these Terms and the other Preview documents. Outputs may not be unique or protectable and may be identical or similar to content generated for another user. HUMAIN does not assign or license third-party rights contained in an Output.

You grant HUMAIN a perpetual, irrevocable, worldwide, royalty-free, transferable and sublicensable license to use feedback, ratings, reports and suggestions for any lawful purpose without compensation or attribution. This clause does not replace consent required for processing personal data.

5. Use Rules and Provider Requirements

You must comply with these Terms, the Model Terms, Acceptable Use Policy, current Applicable Provider Requirements Register, documentation, activation notice, technical limits and all laws applicable to you, your location, your Inputs, your intended use and your treatment of Outputs.

The Provider Requirements Register contains only downstream-relevant use, content, safety, security, access-control and model-protection requirements that HUMAIN has determined apply to the Preview. It does not incorporate the provider's full agreement or public terms, create a contract between you and a provider, or make you a beneficiary of HUMAIN's provider arrangements.

For a matter within the Register's stated scope, the more restrictive applicable requirement controls to the extent of a conflict or silence. No Register provision reduces a mandatory right or HUMAIN obligation under applicable law. Provider changes do not automatically bind you; HUMAIN will issue an updated Register and request renewed electronic acceptance where a material change affects your obligations or access.

6. Recording, Review, Training and Research

Every Input and every Output is recorded and linked to the relevant account. Records may include the model and safeguard configuration, timestamps, request identifiers, token counts, feedback, safety signals, device and browser data, IP address, API identifiers and related logs.

Authorized HUMAIN reviewers and authorized reviewers working for HUMAIN's model technology provider may review interactions under confidentiality, access-control and data-protection obligations. The model technology provider may receive and use Preview data for inference, support, safety, quality, regional alignment, benchmarking, training and further development of HUMAIN M3 and its related safeguards, in accordance with HUMAIN's provider arrangements and applicable law.

Raw, user-linked Inputs and Outputs will ordinarily be retained for twelve (12) months, then deleted or effectively de-identified unless a longer period is required by law or for a documented legal claim. Selected effectively de-identified data may be retained longer for evaluation, safety, training and development where re-identification is not reasonably possible.

Participation in the Preview is voluntary. Recording, review and model-improvement processing are integral to this Preview, but they require separate affirmative electronic consent where HUMAIN relies on consent. HUMAIN will not enable new interactions without the required current consents. Marketing consent is separate.

You may withdraw consent using the mechanism identified in the Privacy Notice or Preview interface. Withdrawal affects future consent-based processing and ends your ability to submit new interactions, without affecting processing already lawfully completed. Data already effectively de-identified or technically incorporated into trained parameters may not be capable of being associated with or removed for an individual, subject to applicable law.

Research Access is an additional, voluntary opt-in. HUMAIN may review and use Research Access prompts, Outputs and feedback for safety reviews, evaluation, training and further development on the same disclosed basis. You may leave Research Access without ending eligible Guarded Access, but withdrawal of an integral data consent ends all new Preview interactions.

7. Availability, Changes and Support

The Preview is provided without any service level, uptime, support, data-recovery or continuity commitment. HUMAIN may add, remove or change a model, safeguard, feature, access mode, output, limit or interface and may interrupt, suspend or withdraw all or part of the Preview at any time.

HUMAIN may provide activation, suspension, change, renewal and other notices through the Preview interface, account, dashboard, email or another reasonable electronic channel. A notice need not be a paper document or separately signed unless applicable law requires otherwise.

You are responsible for retaining any information you are permitted to retain. The Preview may lose or delete content, conversation history, settings or access credentials.

8. Suspension and End of Access

HUMAIN may investigate, warn, restrict, throttle, preserve records, suspend or terminate access immediately where it reasonably believes this is required for law, sanctions, safety, security, privacy, provider compliance, capacity, investigation, service integrity or protection of any person.

You may stop using the Preview and request account closure through the mechanism identified in the interface or Privacy Notice. Termination ends your right to use the Preview. Provisions concerning confidentiality, data use already lawfully completed, feedback, intellectual property, disclaimers, liability, governing law and matters intended to survive will continue.

9. Experimental Output Disclaimer

THE PREVIEW, HUMAIN M3 AND ALL OUTPUTS ARE PROVIDED 'AS IS' AND 'AS AVAILABLE' FOR LIMITED EVALUATION. TO THE MAXIMUM EXTENT PERMITTED BY LAW, HUMAIN AND ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS AND UNDERLYING MODEL TECHNOLOGY PROVIDERS DISCLAIM ALL EXPRESS, IMPLIED, STATUTORY AND OTHER WARRANTIES, INCLUDING ACCURACY, COMPLETENESS, SAFETY, LEGALITY, NON-INFRINGEMENT, MERCHANTABILITY, FITNESS FOR PURPOSE, QUIET ENJOYMENT AND AVAILABILITY.

Neither HUMAIN nor an underlying model technology provider verifies, adopts, endorses or assumes responsibility to you for an Output. An Output is generated probabilistically and may be affected by your Input, system configuration, safeguards and third-party technology. You are solely responsible for independently reviewing every Output and for every decision, communication, publication, implementation or action based on it.

The Preview does not provide legal, medical, financial, investment, tax, religious, employment, educational, governmental, emergency or other professional advice. Do not use an Output as the sole or material basis for a high-impact decision or an action affecting rights, safety, health, livelihood, reputation, finances or access to an essential service.

No disclaimer excludes a responsibility or remedy that cannot lawfully be excluded. References to a provider do not create contractual privity, an enforcement right or a representation made on that provider's behalf.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HUMAIN, ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS AND UNDERLYING MODEL TECHNOLOGY PROVIDERS WILL NOT BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL LOSS; LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, DATA OR OPPORTUNITY; OR LOSS ARISING FROM AN OUTPUT, RELIANCE, UNAVAILABILITY, MODEL CHANGE, SAFEGUARD FAILURE OR UNAUTHORIZED USE, EVEN IF ADVISED OF THE POSSIBILITY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HUMAIN'S TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATING TO THE PREVIEW OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID HUMAIN FOR THE PREVIEW IN THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY AND (B) SAR 500. THE PREVIEW IS EXPECTED TO BE PROVIDED WITHOUT CHARGE.

These exclusions and limits apply regardless of legal theory and allocate the risks of an experimental service. They do not apply to fraud, wilful misconduct, death or personal injury caused by negligence, or another liability that applicable law does not permit to be excluded or limited. Mandatory consumer remedies remain unaffected.

If you use the Preview for an organization, that organization will defend and indemnify HUMAIN and its affiliates, personnel and service providers from third-party claims arising from unlawful Inputs, breach of the Preview documents or unauthorized use, except to the extent caused by the indemnified party's fraud, gross negligence or wilful misconduct. This obligation does not apply to an individual consumer where prohibited by law.

11. Changes to the Documents

HUMAIN may update these Terms or another Preview document to reflect changes in law, the Preview, risks, security practices or binding provider requirements. The updated document will identify its effective or update date and be made available online.

HUMAIN will request renewed affirmative electronic acceptance before continued use where a material contractual change affects your rights, obligations or access. If a processing change requires renewed consent, HUMAIN will request fresh consent. Continued use alone will not substitute for an acceptance or consent that HUMAIN is required to obtain.

12. Governing Law and Disputes

These Terms and non-contractual obligations arising from them or the Preview are governed by the laws of the Kingdom of Saudi Arabia, without regard to conflict-of-law principles.

Subject to any mandatory forum or remedy available to you under applicable consumer or other non-waivable law, the competent courts of Riyadh, Kingdom of Saudi Arabia, have exclusive jurisdiction. Before filing a claim, the parties should attempt in good faith for thirty (30) days to resolve it through the support or legal channel identified in the Preview.

If these Terms are published in Arabic and English, the Arabic version controls to the extent permitted by applicable law, unless HUMAIN expressly states otherwise for a particular regional version.

13. General

These Terms, Model Terms, AUP, applicable Provider Register and any activated Research Access Addendum form the entire agreement concerning the Preview. The Privacy Notice describes data processing. A separate agreement expressly covering the Preview controls for the relevant authorized organizational use to the extent of a conflict.

If a provision is unenforceable, it will be enforced to the maximum lawful extent and the remainder will continue. A delay in enforcement is not a waiver. You may not assign your account or these Terms without HUMAIN's approval. HUMAIN may assign them in connection with a reorganization, merger, financing, sale or transfer of the Preview, subject to applicable law.

Nothing creates employment, agency, partnership, joint venture, fiduciary duty or an entitlement to compensation, attribution, future access or release. An underlying model technology provider is not your contracting party or a third-party beneficiary of these Terms.

Questions, reports and rights requests may be submitted through the relevant channel identified in the Preview interface or Privacy Notice. Formal notices to HUMAIN may be directed to [email protected].
